The Customer declares that they have read these General Terms and Conditions of Sale and have accepted them by checking the box provided for this purpose before initiating the online ordering process, as well as the general terms of use of the website Becquet-Voiture.com.
As these General Terms and Conditions of Sale may be subject to subsequent modifications, the version applicable to the Customer's purchase is the one in force on the website on the date the order is placed.

Customs duties or other local taxes, import duties, or state taxes may be payable. They shall be borne by and remain the sole responsibility of the Customer.
Changes to these General Terms and Conditions of Sale are binding on users of the website
Becquet-Voiture.com from the date they are published online and cannot apply to transactions concluded prior to that date.
ARTICLE 2 – Orders
It is the Customer's responsibility to select on the website Becquet-Voiture.com the Products they wish to order, according to the following terms:
- Description of the order placement and validation process, the confirmation of said order, and payment.
The contractual information is presented in French and is subject to confirmation no later than the time the Customer validates the order.
Product offers are valid as long as they are visible on the website, subject to available stock.
The sale will only be considered final after the Seller sends the Customer confirmation of acceptance of the order by email, and after the Seller has received payment in full of the price and/or after the Seller has received payment in full of the deposit due.
For orders placed exclusively online, an order is registered on the Provider's website when the Customer accepts these General Terms and Conditions of Sale by checking the box provided for this purpose and validates their order.
The Customer has the opportunity to review the details of their order, its total price, and correct any errors before confirming their acceptance (Article 1127-2 of the Civil Code). This validation implies acceptance of all these General Terms and Conditions of Sale and constitutes proof of the sales contract.
It is therefore the Customer's responsibility to check the accuracy of the order and immediately report any errors.
Any order placed on the website Becquet-Voiture.com constitutes the formation of a contract concluded remotely between the Customer and the Seller.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.
The Customer can track the progress of their order on the website Becquet-Voiture.com
If orders are limited
The Seller does not intend to sell the Products on the website Becquet-Voiture.com to professionals, but only to consumers or non-professionals, for their personal needs.
The Seller therefore reserves the right to refuse orders for the same Product in large quantities containing more than 10 identical items.
If an order can only be fulfilled from a certain amount or quantity:
No order for an amount less than 0 euros including VAT or for a quantity of products less than 0 can be accepted.
Any modifications to the order by the Customer may only be taken into account by the Seller within the limits of their possibilities and provided they are notified by email to the Seller at least 1 day before the scheduled shipping date of the order.
In the event that these modifications cannot be accepted by the Seller, the sums paid by the Customer will be refunded to them within a maximum period of 30 days from the notification of the impossibility to accept the modifications requested by the Customer (unless the Customer prefers to receive a credit note).
If a deposit is paid with the order:
In the event of cancellation of the order by the Customer after its acceptance by the Seller less than 3 days before the scheduled date for the supply of the ordered Products, for any reason other than the exercise of the right of withdrawal or force majeure, the deposit paid with the order, as defined in Article “Payment Terms” of these General Terms and Conditions of Sale, will automatically become the property of the Seller and cannot give rise to any refund.
If no deposit has been paid with the order :
In the event of cancellation of the order by the Customer after its acceptance by the Seller less than 1 day before the scheduled date for the supply of the ordered Products, for any reason other than the exercise of the right of withdrawal or force majeure, an amount corresponding to 15 % of the total purchase price will be acquired by the Seller and invoiced to the Customer, as liquidated damages, in compensation for the loss thus suffered.
ARTICLE 3 - Prices
The Products are provided at the prices in force shown on the website Becquet-Voiture.com, at the time the order is registered by the Seller. Prices are expressed in Euros, excluding and including VAT.
The prices take into account any discounts that may be granted by the Seller on the website Becquet-Voiture.com
These prices are fixed and non-revisable during their period of validity, as indicated on the website Becquet-Voiture.com, the Seller reserving the right, outside this period of validity, to change the prices at any time. They do not include processing, shipping, transport, and delivery fees, which are charged additionally, under the conditions indicated on the website Becquet-Voiture.com and calculated prior to placing the order.
The payment requested from the Customer corresponds to the total purchase amount, including these fees.
Specific Customer orders may be considered. If so, they will be subject to a quote previously accepted by the Customer. Quotes established by the Seller are valid for a period of 1 month, from the date of their establishment.
The order based on a quote is only considered accepted after payment of a deposit of 60 % of the order amount.
An invoice is established by the Seller and provided to the Customer upon receipt of payment.
ARTICLE 4 - Payment Terms
The price is payable on demand, in full on the day the Customer places the order, by secure payment, according to the following terms:
- by bank cards: Visa, MasterCard, American Express, other bank cards
- by phone
- by PayPal
- by private cards
- by bank check, for any order greater than or equal to 500 euros including VAT.
- OTHERS: stripe, apple pay
In the event of payment by bank check, it must be issued by a bank domiciled in mainland France or Monaco.
The check is deposited upon receipt.
Payment data is exchanged in encrypted mode using the PAYPAL, STRIPE
If payment is only debited upon shipping the order:
In the event of payment by bank card, the card is only debited at the time of shipping the order.
The Seller will not be required to deliver the Products ordered by the Customer if the Customer does not pay the Seller the price in full under the conditions indicated above.
Payments made by the Customer will only be considered final after the Seller has actually received the sums due.
Furthermore, the Seller reserves the right, in the event of non-compliance with the payment terms set out above, to suspend or cancel the delivery of the Customer's pending orders.
No additional fee exceeding the costs incurred by the Seller for the use of a payment method may be charged to the Customer.
ARTICLE 5 - Deliveries
The Products ordered by the Customer will be delivered in mainland France (and in the following countries: worldwide) within the shipping time indicated on the Product sheet, plus the processing and transit time to the address indicated by the Customer when placing their order on the website Becquet-Voiture.com
Delivery consists of transferring physical possession or control of the Product to the Customer.
Except in special cases or the unavailability of one or more Products, the ordered Products will be delivered in a single shipment.
The Seller undertakes to make its best efforts to deliver the products ordered by the Customer within the timeframes specified above.
However, these timeframes are provided for guidance only.
If the ordered Products have not been delivered within 30 days after the indicative delivery date, for any reason other than force majeure or the Customer's own actions, the sale may be rescinded at the Customer's written request under the conditions provided for in Articles L 216-2, L 216-3 and L241-4 of the French Consumer Code.
The sums paid by the Customer will then be refunded to them no later than fourteen days after the date of termination of the contract, excluding any compensation or deductions.
If deliveries are carried out by an independent carrier:
Please note:
Pursuant to the Ordinance of 14 March 2016 relating to the legislative part of the French Consumer Code, when the Seller is responsible for the delivery of the sold goods, the risk of loss or deterioration of these goods shall only pass to the consumer at the moment they take physical possession of them (French Consumer Code, Art. L 216-4). Under current common law rules, goods travel at the owner's risk and peril, who is usually the customer (French Civil Code, Art. 1196, 1344-2 and 1624 ; French Commercial Code, Art. L 132-7). In the case of a contract concluded at a distance, the Court of Cassation had already ruled that the Seller who has entrusted the delivery of goods to a carrier is solely liable to the customer when the goods have been lost during transport (Cass. 1st Civ. 13-11-2008 No. 07-14.856: RJDA 10/09 No. 838). This ruling now applies to all sales concluded by a consumer. However, the postponement of the transfer of risk to the date of taking possession includes one exception: the risk will pass to the consumer upon delivery of the goods to the carrier when the consumer has appointed the carrier to carry out the transport and the professional has not offered a choice.Art. L 216-5).
Deliveries are carried out by an independent carrier to the address provided by the Customer when placing the order, which the carrier can easily access.
When the Customer has personally arranged for a carrier of their choice to carry out the delivery, delivery is deemed to have taken place when the Seller hands over the ordered Products to the carrier, provided that the Seller has handed over the sold Products to the carrier, which accepted them without reservation.
The Customer therefore acknowledges that the carrier is responsible for carrying out the delivery and has no recourse against the Seller in the event of a failure to deliver the transported goods.
If the Customer makes a special request regarding the packaging or transport conditions of the ordered products, duly accepted in writing by the Seller, the associated costs will be subject to a separate additional charge, based on a quote previously accepted in writing by the Customer.
If deliveries can also take place in-store:
The Seller also offers free delivery to one of its stores, the list of which can be found on the Becquet-Voiture.com website, for a minimum order amount of 1,000 euros.
The Customer is required to check the condition of the delivered products.
They have a period of 3 days from delivery to submit by email, any reservations or complaints regarding non-conformity or apparent defects in the delivered Products (for example, an already opened damaged package...), along with all relevant supporting documents (including photographs).
After this period and if these formalities have not been followed, the Products will be deemed to conform and free from any apparent defects, and no complaint can be validly accepted by the Seller.
The Seller will refund or replace as soon as possible, at its own expense, the delivered Products whose non-conformity or apparent or latent defects have been duly proven by the Customer, under the conditions provided for in Articles L 217-4 et seq. of the French Consumer Code and those provided for in these General Terms and Conditions of Sale (see warranties, in particular).
ARTICLE 6 - Transfer of Ownership - Transfer of Risk
The transfer of ownership of the Products from the Seller to the Customer will only take place after the Customer has paid the price in full, regardless of the delivery date of the Products.
Regardless of the date of transfer of ownership of the Products, the transfer of risk of loss and deterioration shall only take place at the moment the Customer takes physical possession of the Products. The Products therefore travel at the Seller's risk and peril.
ARTICLE 7 - Right of Withdrawal
In accordance with the legal provisions in force, the Customer has a period of fourteen days from receipt of the Product to exercise their right of withdrawal with the Seller, without having to provide reasons or pay a penalty, for the purpose of exchange or refund, provided that the Products are returned in their original packaging and in perfect condition within 30 days following the notification to the Seller of the Customer's decision to withdraw.
Returns must be made in their original condition and complete (packaging, accessories, user manual...), allowing them to be returned to the market in new condition, accompanied by the purchase invoice.
Damaged, soiled, or incomplete Products will not be accepted.
The right of withdrawal may be exercised online using the withdrawal form available on the Becquet-Voiture.com website, in which case an acknowledgment of receipt on a durable medium will be immediately communicated to the Customer by the Seller, or any other unambiguous statement expressing the intention to withdraw.
If the right of withdrawal is exercised within the aforementioned period, only the price of the purchased Product(s) and the delivery costs will be refunded; return costs remain the responsibility of the Customer.
The exchange (subject to availability) or refund will be carried out within 10 days from the date the Seller receives the Products returned by the Customer under the conditions provided for in this article.
ARTICLE 8 - Seller's Liability - Warranty
The Products sold on the Becquet-Voiture.com website conform to the regulations in force in France and have performance characteristics compatible with non-professional use.
The Products provided by the Seller benefit by operation of law and without additional payment, independently of the right of withdrawal, in accordance with the legal provisions:
- the legal guarantee of conformity, for Products that are apparently defective, damaged, or do not correspond to the order,
- the legal guarantee against latent defects resulting from a defect in material, design, or manufacturing that affect the delivered products and make them unfit for use,
under the conditions and according to the procedures referred to in the box below and defined in the appendix to these General Terms and Conditions of Sale (Guarantee of Conformity / Guarantee against Latent Defects).
To assert their rights, the Customer must inform the Seller in writing of the non-conformity of the Products within a maximum period of 3 days from delivery of the Products or the discovery of latent defects within the timeframes specified above, and return or bring the defective Products to the store in the condition in which they were received, along with all components (accessories, packaging, user manual...).
The Seller will refund, replace, or repair the Products or parts covered by warranty that are deemed non-conforming or defective.
Shipping costs will be refunded based on the invoiced rate, and return costs will be refunded upon presentation of supporting documents.
Refunds for Products deemed non-conforming or defective will be carried out as soon as possible and no later than 15 days following the Seller's discovery of the non-conformity or latent defect.
The refund will be made by credit to the Customer's bank account or by bank check sent to the Customer.
The Seller cannot be held liable in the following cases:
- failure to comply with the legislation of the country in which the products are delivered, which the Customer is responsible for checking,
- misuse, use for professional purposes, negligence, or lack of maintenance on the part of the Customer, as well as normal wear and tear of the Product, an accident, or force majeure.
The Seller's warranty is, in any event, limited to the replacement or refund of non-conforming Products or Products affected by a defect.
If a contractual warranty is provided :
Products purchased on the Becquet-Voiture.com website may benefit, in addition to the legal guarantees of conformity and against latent defects, from a paid contractual warranty, as indicated in the description of each relevant Product, according to the terms, conditions, and rates set out in the appendix to these General Terms and Conditions of Sale (Warranty Contract).
Contractual warranties cover ”List of contractual warranties” excluding ”List of situations not covered by contractual warranties”.
If applicable, the purchased Product also benefits from a manufacturer's commercial warranty (please refer to the terms of the manufacturer's warranty, if any, provided in the packaging of said Product).
ARTICLE 9 - Data Protection
Pursuant to the French Law of 6 January 1978, it is recalled that the personal data requested from the Customer are necessary for the processing of their order and the issuance of invoices, among other purposes.
This data may be communicated to the Seller's partners responsible for the execution, processing, management, and payment of orders.
The processing of information provided through the Becquet-Voiture.com website has been declared to the CNIL.
In accordance with current national and European regulations, the Customer has a permanent right of access, modification, rectification, and objection regarding information concerning them.
This right may be exercised under the conditions and procedures defined on the Becquet-Voiture.com website
ARTICLE 10 - Intellectual Property
The content of the Becquet-Voiture.com website is the property of the Seller and its partners and is protected by French and international intellectual property laws.
Any total or partial reproduction of this content is strictly prohibited and may constitute a counterfeiting offense.
Furthermore, the Seller retains ownership of all intellectual property rights in photographs, presentations, studies, drawings, models, prototypes, etc., created (even at the Customer's request) for the purpose of providing the Services to the Customer.
The Customer is therefore prohibited from reproducing or exploiting said studies, drawings, models, prototypes, etc., without the express, written, and prior authorization of the Seller, which may be subject to financial consideration.
ARTICLE 11 - Unforeseen Circumstances
The Parties have agreed, within the framework of the provisions of Article 1195 of the French Civil Code, that a change in circumstances such as financial, economic, or material,... surrounding the conclusion of a sale of the Seller's products subject to these General Terms and Conditions of Sale and resulting in an increase in the price which will be fully borne by the Customer, even if these risks make the performance of their obligations excessively burdensome for the Customer, all other risks being borne by the other Party.
However, if the unforeseeable change in circumstances at the time of concluding the contract was permanent or continued beyond 1 month, these terms shall be purely and simply rescinded according to the procedures defined in the "Rescission for Unforeseen Circumstances" article.
ARTICLE 12 - Specific Performance
In the event of a failure by either Party to fulfill its obligations, the Party affected by the default has the right to request specific performance of the obligations arising from these terms. Notwithstanding the provisions of Article 1221 of the French Civil Code, the creditor of the obligation may pursue this specific performance after a simple formal notice, sent to the debtor of the obligation by registered letter with acknowledgment of receipt, which remains unanswered, regardless of the circumstances and even if there is a manifest disproportion between its cost to the debtor and its benefit to the creditor.
It is recalled that in the event of a failure by either Party to fulfill its obligations, the Party affected by the default may, in accordance with the provisions of Article 1222 of the French Civil Code, 10 days after sending a formal notice to perform which remains unanswered, have the obligation performed by a third party at the expense of the defaulting Party, provided that the cost is reasonable and consistent with market practices, without judicial authorization being necessary for this purpose, as the Party affected by the default may also, at its choice, ask the court to order the defaulting Party to advance the sums necessary for this performance.
ARTICLE 13 - Exception of Non-Performance
It is recalled that, pursuant to Article 1219 of the Civil Code, each Party may refuse to perform its obligation, even if due, if the other Party does not perform its own and if this non-performance is sufficiently serious, that is, likely to call into question the continuation of the contract or to fundamentally upset its economic balance. The suspension of performance shall take effect immediately upon receipt by the defaulting Party of the notice of default sent to it by the Party affected by the default, indicating the intention to invoke the exception of non-performance until the defaulting Party has remedied the identified default, served by registered letter with acknowledgment of receipt or by any other durable written means allowing proof of dispatch.
This exception of non-performance may also be used preventively, in accordance with the provisions of Article 1220 of the Civil Code, if it is manifest that one of the Parties will not perform its obligations when due and that the consequences of this non-performance are sufficiently serious for the Party affected by the default.
This right is exercised at the risk and peril of the Party that takes the initiative.
The suspension of performance shall take effect immediately upon receipt by the alleged defaulting Party of the notice of the intention to invoke the preventive exception of non-performance until the alleged defaulting Party performs the obligation for which a future default is manifest, served by registered letter with acknowledgment of receipt or by any other durable written means allowing proof of dispatch.
If the impediment were permanent or continued beyond 30 days, these presents would be terminated outright in accordance with the procedures set out in the article “Termination for a Party's Breach of Its Obligations”.
ARTICLE 14 - Force majeure
The Parties shall not be held liable if the non-performance or delay in the performance of any of their obligations, as described herein, results from an event of force majeure within the meaning of Article 1218 of the Civil Code.
The Party discovering the event must immediately inform the other Party of its inability to perform its obligation and justify this to the other Party. The suspension of obligations shall in no case give rise to liability for non-performance of the obligation in question, nor shall it result in the payment of damages or late penalties.
The performance of the obligation is suspended for the entire duration of the force majeure event if it is temporary and does not exceed 30 days.
Consequently, as soon as the cause of the suspension of their mutual obligations ceases, the Parties shall make every effort to resume the normal performance of their contractual obligations as quickly as possible. To this end, the impeded Party shall notify the other of the resumption of its obligation by registered letter with acknowledgment of receipt or by any other extrajudicial means. If the impediment is permanent or exceeds 30 days, these presents shall be terminated outright in accordance with the procedures set out in the article “Termination for Force Majeure”.
During this suspension, the Parties agree that the costs incurred by the situation shall be borne by the impeded Party.
ARTICLE 15 - Termination of the contract
15-1- Termination for hardship
Termination due to the impossibility of performing an obligation that has become excessively onerous may only occur 10 days after the dispatch of a formal notice declaring the intention to apply this clause, notified by registered letter with acknowledgment of receipt or by any other extrajudicial means, notwithstanding the “Termination for a Party's Breach of Its Obligations” clause set out below.
15-2 - Termination for a sufficiently serious breach of an obligation
The Party affected by the default may, notwithstanding the “Termination for a Party's Breach of Its Obligations” clause set out below, in the event of a sufficiently serious breach of any of the obligations incumbent on the other Party, notify the Defaulting Party by registered letter with acknowledgment of receipt of the wrongful termination of these presents 10 days after the dispatch of a formal notice to perform has remained unsuccessful, pursuant to the provisions of Article 1224 of the Civil Code.
15-3 - Termination for force majeure
It is expressly agreed that the Parties may terminate this contract by operation of law, without formal notice or formality.
15-4 - Termination for a Party's Breach of Its Obligations
Note: The termination clause must specify the commitments whose non-performance will result in the termination of the contract, which should be listed in the termination clause itself (Article 1225 of the Civil Code). It may only be enforced after a formal notice expressly mentioning the termination clause has remained unsuccessful, and it is specified that the Parties may agree in their contract that the formal notice shall result solely from the non-performance itself (Article 1344 of the Civil Code).
In the event of non-compliance by either Party with the following obligations:
“For example, non-payment by the due date of the services ordered by the Customer”
referred to in the articles of this contract, the latter may be terminated at the discretion of the aggrieved Party.
It is expressly understood that this termination for a Party's Breach of Its Obligations shall occur by operation of law, the formal notice resulting solely from the non-performance of the obligation, without formal notice or performance of formalities.
15-5 - Common provisions for cases of termination
It is expressly agreed between the Parties that the debtor of an obligation to pay under this agreement shall be validly served with formal notice solely by the enforceability of the obligation, in accordance with the provisions of Article 1344 of the Civil Code.
The services exchanged between the Parties from the conclusion of the contract until its termination, which can only be useful through its full performance, shall give rise to full restitution.
ARTICLE 16 - Applicable Law - Language
Note: The contract concluded between a consumer and a professional may be subject to the law of a State that is not a member of the European Union, but this choice must not deprive the consumer of the protection granted by the mandatory rules of community law transposed into domestic law when this contract has a close link with the territory of a Member State.
The Ordinance of March 14, 2016, No. 2016-301, relating to the legislative part of the Consumer Code, establishes an identical presumption of a close link between the contract and a Member State in the following cases, notably (Art. L231-1), this list being non-exhaustive:
the contract was concluded in the Member State of the consumer's habitual residence; the professional directs its activity towards the territory of the Member State where the consumer resides, provided that the contract falls within the scope of this activity; the contract was preceded in that Member State by an offer made specifically or by advertising and by acts performed by the consumer necessary to conclude this contract; the contract was concluded in a Member State where the consumer went following a travel or stay proposal made, directly or indirectly, by the seller to induce them to conclude this contract. The fact that a trader has directed its activity towards a Member State also allows the determination of the national jurisdiction competent to hear an intra-Community dispute relating to a contract concluded by a consumer (Reg. 44/2001 of 22-12-2000 Art. 15, § 1-c). For the application of this text, it has been ruled that the mere use of a website by the trader is not sufficient to consider that it directs its activity towards the Member State of the consumer who makes a purchase through this website (CJEU 7-12-2010 Case 585/08 and 144/09: RJDA 2/11 No. 205). Other indicators are necessary, for example the drafting of the website in a language other than that of the trader.
These General Terms and Conditions of Sale and the operations resulting therefrom are governed by and subject to French law.
These General Terms and Conditions of Sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.
ARTICLE 17 - Disputes
All disputes to which the purchase and sale operations concluded pursuant to these general terms and conditions of sale could give rise, concerning both their validity, their interpretation, their performance, their termination, their consequences and their effects, and which could not have been resolved between the seller and the customer, shall be submitted to the competent courts under common law conditions.
The Customer is informed that they may in any event resort to conventional mediation, notably with the Consumer Mediation Commission (Consumer Code Art. L 612-1) or with the existing sectoral mediation bodies, the references to which appear on the website “Becquet-Voiture.com » or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.
ARTICLE 18 - Pre-contractual Information - Customer Acceptance
The fact for a natural person (or legal entity) to order on the website “Becquet-Voiture.com » implies adherence and full acceptance of these General Terms and Conditions of Sale and the obligation to pay for the Products ordered, which is expressly acknowledged by the Customer, who waives, notably, the right to rely on any contradictory document that would be unenforceable against the Seller.
ANNEX I - Provisions relating to legal guarantees
Article L217-4 of the Consumer Code:
The seller is required to deliver goods that conform to the contract and is liable for non-conformities existing at the time of delivery. They are also liable for non-conformities resulting from packaging, assembly instructions, or installation when this has been made their responsibility by the contract or has been carried out under their responsibility.
Article L217-5 of the Consumer Code:

- Or presenting the characteristics agreed upon by the Parties or being suitable for any special use sought by the buyer, brought to the knowledge of the seller and which the latter has accepted.
Article L217-12 of the Consumer Code:
The action resulting from non-conformity is time-barred after two years from the delivery of the goods.
Article L217-16 of the Consumer Code:

This period runs from the buyer's request for intervention or the making available of the goods in question for repair, if this making available is subsequent to the request for intervention.
Article 1641 of the Civil Code:
The seller is liable under the warranty for hidden defects of the sold item that make it unfit for the use for which it is intended, or that so diminish this use that the buyer would not have acquired it, or would have given it a lower price, had they known of them.
Article 1648, first paragraph of the Civil Code:
The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.
ANNEX II - Withdrawal Form
This form must be completed and returned only if the Customer wishes to withdraw from the order placed on “Becquet-Voiture.com » except for exclusions or limitations on the exercise of the right of withdrawal according to the applicable General Terms and Conditions of Sale.
